KEVIN WEST SUBSCRIPTION PROMOTION

Rules and Regulations for the Kevin West Subscription Promotion (KWSP):

1. Must be 18 years old or older. The Date Of Birth box must be filled in correctly or this could be grounds for disqualification.

2. Winners consent to participating in promotional schemes (if any) of kevin-west.com and cherrydecena by clicking the submit button and by claiming the prize. Winners also consent to the use of their name, picture and/or details for promotional purposes (if any).

3. The Judge's decision is final. The named Judge is the appointed staff by cherrydecena. To contact the named Judge, please email ads@cherrydecena.co.uk with the headings or subject line of Kevin West Subscription Promotion. Disputes will be moderated by cherrydecena's appointed named Judge.

4. This promotion is also governed by and complies with the Terms and Conditions of the sponsor, cherrydecena, and that of the chippendales.com.

5. The address provided in the subscription form must be correct and valid. Otherwise the post office tends to send the prize back to us with an "Address Unknown" message.

• The winning prize will only be sent to the address provided in the subscription form. We apologize that we cannot send it and/or correspond to any other address, so please make sure that your address is correct. For the purposes of this promotion, changes of address is not allowed. For change of details for members, please go to the Members Section.
• In the event that there was an error in the address that was provided in the subscription form, the Kevin West Subscription Promotion waives all liabilities arising from this error. The subscription applicant is responsible for ensuring that correct details are entered in the subscription form.
• Addresses outside the UK - please allow extra mailing time.
• Costs of mailing of the prize to the winner will be shouldered by cherrydecena.
• Mailing priority and manner will be dictated by the named Judge.
• Only one entry is allowed per household.

6. There is no monetary equivalent to the prize. The prize cannot be changed to cash nor any other form and is non-transferable to any other person.

7. Winners will be notified by email. Therefore please make sure that your email address is correct and please check your email inbox for winning notifications as a time-limited response is required from the winner, or the prize will be forfeited (please see section 8).

• The winner will be notified by admin@kevin-west.com.
• It is therefore advised that this email address be included in your contacts addressbook to ensure that our email notification will not be filtered by your spam filtering system and will go to your inbox and not to you spam folder.
• In the event that there was an error in the email address that was provided in the subscription form, the Kevin West Subscription Promotion waives all liabilities arising from this error. The subscription applicant is responsible for ensuring that correct details are entered in the subscription form.

8. If no response is received from the winning party within 3 days, the prize will be forfeited. In which case another winner will be drawn from the pool of participating subscription applications for that particular draw.

9. One promotional period is three months or one quarter. A winner will be drawn from a pool of subscription applications every three months or every quarter. All subscription applications submitted in that quarter is eligible for entry for the draw in that quarter unless the subscription application falls under sections 9 and 10 of the KWSP rules and regulations. Subscription applications in that quarter is no longer eligible for entry for subsequent draws in subsequent quarters.

10. Subscription applications of previous members who cancelled and re-applied are not eligible for entry into the draw. Re-applications and re-submitions of subscription applications are also not eligible for entry into any draws. Meaning, only first time qualifying subscription applications are eligible for entry.

11. Only qualifying subscription applications are eligible for entry into the draw. This means that only applications which comply with the T&C can enter the draw, i.e. :

• does not violate any of the provisions in the terms and conditions of kevin-west.com, cherrydecena and chippendales.com
• subscription application submitted within that particular quarter for the draw
• email verification received from applicant
• no phishing or viruses associated with the submitted application
• the subscription application was not declined by kevin-west.com

12. The prize for that particular draw will be as stated in the subscription page. For Jan-Mar 2009 quarter, the prize is a Kevin West 2009 calendar.

• Prizes are subject to change from quarter to quarter. Future prizes will be announced as far in advance as possible, however, this could change before the actual quarter starts. Therefore, please keep yourselves posted. Changes will be posted in the subscription page.
• kevin-west.com and cherrydecena will not be responsible for any damages incurred during mailing or sustained while the prize is under the custody of the post office. Lost or damaged prize while in transit with the post office will not be replaced as a principle. However concessions may be considered for the lost or damaged prize while under the custody of the post office, depending on a case-to-case basis and availability of item(s). 13. If prize is not received by the winner after the expected waiting time, please notify us at support@kevin-west.com so that we can follow it up with the post office at our end.

14. In the event that there was an error in the details that was provided in the subscription form, the Kevin West Subscription Promotion waives all liabilities arising from this error. The subscription applicant is responsible for ensuring that correct details are entered in the subscription form.

15. Multiple email entries per one person is not eligible for entry into the draw. An applicant must use only one email to apply for membership. If a person makes multiple applications, this could be grounds for disqualification. In the event that his/her name was drawn to win in that quarter, his/her prize will be forfeited and another winner will be drawn from the pool of qualified entries. The idea is to give everybody a fair chance, not to cheat your way into winning the prize by increasing your chances of winning by sending in multiple entries.

16. Membership must be maintained at least until the end of that quarter (one quarter is equivalent to three months of the 12-month calendar year) or at least until the end of the draw for that quarter. Non-compliance to this rule will disqualify an entry to the prize draw.

17. If the first winner has defaulted, a second winner will be drawn. If the second winner for that quarterly draw defaults a well, a third winner will be drawn. If the third winner also defaults, then the prize for that quarter will be forfeited and a "No Winner" status will be declared. If there are not enough entries for that quarter to draw a second and a third winner, then a "No Winner" status will be declared for that quarterly draw.
